Terms & Conditions
MobilityFunder Supporter Terms & Conditions
Effective Date: August 7, 2026
These Supporter Terms & Conditions ("Terms") apply whenever you make a contribution through MobilityFunder.
MobilityFunder is operated by Tadpole Adaptive, LLC ("Tadpole," "MobilityFunder," "we," "us," or "our").
By submitting a contribution, you agree to these Terms.
1. What Your Contribution Supports
MobilityFunder helps families and individuals bring their communities together to help fund adaptive equipment available through Tadpole Adaptive.
When you contribute to a MobilityFunder campaign, your contribution is intended to help fund adaptive equipment for the person identified in that campaign.
Your payment is not an investment, loan, purchase of ownership, or payment directly to the Campaign Creator.
2. Contributions Are Applied Toward Adaptive Equipment
Campaign contributions are collected through MobilityFunder and are applied toward the recipient's adaptive-equipment purchase through Tadpole Adaptive.
Campaign Creators do not receive the contributed funds as cash.
If a campaign reaches its goal, available funds are applied toward the related Tadpole Adaptive order or invoice.
If a campaign does not reach its full goal, successfully collected funds may remain available as Tadpole Adaptive store credit toward adaptive equipment for the intended recipient.
Where appropriate, funds may be applied toward another suitable adaptive product if the originally featured product is no longer appropriate or available.
3. A Campaign Does Not Have to Reach 100%
Your contribution can still help even if the campaign does not reach its full goal.
Partially raised funds may remain available toward the recipient's adaptive equipment through Tadpole Adaptive.
The Campaign Creator may choose to cover the remaining balance, continue working toward the purchase, or explore another appropriate equipment option with Tadpole Adaptive.
4. Contributions Are Not Charitable Donations
Unless a campaign expressly states otherwise, contributions made through MobilityFunder are not charitable donations to a tax-exempt organization and should not be assumed to be tax deductible.
MobilityFunder and Tadpole Adaptive do not provide tax advice.
Please consult your tax professional if deductibility is important to you.
5. Payment Processing
Online payments are processed using third-party payment providers.
By submitting a contribution, you authorize the applicable payment provider to charge the payment method you select for the amount displayed at checkout.
Available payment methods may include credit or debit cards and supported digital wallets such as Apple Pay or Google Pay.
Payment methods may vary by device, location, payment provider, or platform availability.
6. Payment Errors, Disputes, and Chargebacks
If you believe a payment was made in error, please contact MobilityFunder promptly so we can review the situation.
You should not knowingly submit a false or fraudulent chargeback.
Banks, card networks, and payment providers may independently reverse or dispute payments. When that occurs, MobilityFunder may adjust the campaign's displayed total or available funds.
7. Refunds
Contributions are intended to support the adaptive-equipment goal described on the campaign page and generally should be considered final once successfully processed.
However, MobilityFunder may provide a refund when:
- a payment was made in error;
- a duplicate payment occurred;
- a refund is required by law;
- a payment provider requires the transaction to be reversed;
- a campaign cannot reasonably proceed;
- there is evidence of fraud or material misrepresentation; or
- MobilityFunder determines that a refund is otherwise appropriate.
Refund requests are reviewed individually and are not guaranteed.
If funds have already been applied to or committed toward an equipment purchase, our ability to issue a voluntary refund may be limited.
8. Equipment, Timing, and Availability
Adaptive equipment is often specialized, configured for an individual user, manufactured to order, or subject to changing availability.
A fully funded campaign therefore does not necessarily mean the equipment will ship immediately.
Product pricing, specifications, availability, manufacturer lead times, and other circumstances can change after a campaign begins.
When necessary, Tadpole Adaptive may work with the Campaign Creator to identify an appropriate alternative.
9. Campaign Information
Campaign stories and information are generally provided by the Campaign Creator and may be edited by MobilityFunder for clarity, privacy, accessibility, formatting, or presentation.
We make reasonable efforts to review campaigns before publication, but MobilityFunder cannot independently verify every personal statement or circumstance described by a Campaign Creator.
If we discover information suggesting that a campaign contains material misrepresentations, fraud, or other serious problems, we may pause, investigate, modify, or remove the campaign.
10. Anonymous Contributions
Where offered, you may choose to have your contribution displayed anonymously to the public.
MobilityFunder, Tadpole Adaptive, payment processors, financial institutions, and service providers may still receive information necessary to process and administer your payment.
Choosing "anonymous" therefore affects public display and does not mean the transaction itself is legally or technically anonymous.
11. Messages and Public Information
If MobilityFunder allows supporters to leave a name, message, or other public information, you are responsible for ensuring that your submission is appropriate.
Do not submit unlawful, abusive, discriminatory, threatening, misleading, advertising, or privacy-invasive content.
We may edit, decline to publish, or remove supporter content when reasonably necessary.
12. No Ownership or Control
Making a contribution does not give a supporter ownership of the equipment, control over the Campaign Creator, or authority to determine how the recipient uses the equipment.
Once campaign funds are properly applied toward adaptive equipment for the intended recipient, the supporter does not retain an ownership interest in those funds or products.
13. No Guarantee
MobilityFunder cannot guarantee that:
- a campaign will reach its funding goal;
- a specific product will remain available;
- equipment will be delivered by a particular date;
- the recipient's circumstances will remain unchanged; or
- the equipment will produce any particular medical, therapeutic, educational, mobility, or quality-of-life outcome.
MobilityFunder helps communities fund adaptive equipment; it does not guarantee results.
14. Prohibited Transactions
You may not use MobilityFunder:
- with a stolen or unauthorized payment method;
- to test payment cards;
- to disguise the source of funds;
- for money laundering or unlawful financial activity;
- to manipulate campaign totals;
- to harass a Campaign Creator or recipient; or
- for any other fraudulent or unlawful purpose.
Transactions suspected of prohibited activity may be declined, canceled, refunded, reported, or investigated as appropriate.
15. Third-Party Services
MobilityFunder relies on third-party services for functions including payment processing, ecommerce infrastructure, hosting, communications, and other technology.
Those services may have their own terms and privacy practices.
To the extent permitted by law, MobilityFunder is not responsible for interruptions or failures caused by services outside our reasonable control.
16. Changes to These Terms
We may update these Terms as MobilityFunder evolves.
The Terms in effect when you make a contribution will generally apply to that transaction, except when a later change is required by law or necessary to address fraud, security, payment processing, or platform integrity.
17. Limitation of Responsibility
To the fullest extent permitted by law, MobilityFunder and Tadpole Adaptive are not responsible for indirect or consequential losses resulting from use of the platform or circumstances outside our reasonable control.
Nothing in these Terms limits any consumer right or other protection that cannot legally be waived.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
To the extent permitted by law, disputes relating to these Terms or a MobilityFunder contribution will be handled in the appropriate state or federal courts serving San Diego County, California.
